Fair Work Australia: Unfair dismissal and unlawful termination

  • Unfair dismissals are now dealt with by the new government agency, Fair Work Australia.
  • Unlawful termination of employment cases (filed at Fair Work Australia/Federal Magistrates' Court) involve loss of employment on discriminatory grounds. It can be unlawful to sack a worker for reasons that include, for example, his or her gender, age, or ethnicity; or because of family responsibilities or a disability.
  • At MAX LEGAL we can assess your potential claim.  Sometimes an unfair/unlawful dismissal claim is appropriate, but often there is  a better legal option.

Sexual harassment, discrimination and victimisation cases

Complaints about sexual harassment, discrimination and victimisation—regardless of whether the employment has finished or not—can be processed in:

  • the Victorian Equal Opportunity and Human Rights Commission (VEOHCR);
  • the Victorian Civil and Administrative Tribunal (VCAT);
  • the Federal Human Rights and Equal Opportunity Commission; and
  • the Federal Magistrates' Court (FMC).

Wrongful dismissal/breach of contract

This is now a commonly used option for people who feel they have been unfairly dismissed. These rights will continue into the future. Cases are generally run in the Victorian Magistrates' Court or the Federal Magistrates' Court.

Warning: unqualified "advisers" and "advocates"

We have seen an increasing number of cases where unqualified "agents" or "advocates" take on cases for people and leave them high and dry when things go off the rails. Because they are not legally trained, they are unaware of many legal options - and legal risks to you - and cannot represent you in most courts.

Governments have done little to stop the proliferation of these unregulated types who exploit loopholes by heavy internet advertising. This problem is expected to become worse with the new  Fair Work Australia regime. Imagine being ripped off by an unqualified agent and having nobody  to complain to! That is what has happened in numerous cases.

Only a properly qualified and registered lawyer is allowed to give legal advice. It is a serious offence for an unqualified person to give legal advice.  Even if you don't choose us, be smart and choose a member of the LIV or the Law Society in your State. All lawyers have compulsory insurance to protect you, and are fully regulated by law.  

You should report any unqualified person who misleads you into believing they can give legal advice to your State's Law Society.
