DO I REALLY NEED “LEGAL ADVICE?”

Be warned - employment law is very complex. Employment disputes involve many areas of law; contracts, defamation, torts, discrimination and equal opportunity law to name a few. You really need a fully qualified lawyer who is experienced in employment law to guide you.

When you instruct MAX LEGAL, you can be sure that a fully qualified lawyer will personally represent you and take responsibility for what our office does.

Even if you don't choose us, please ensure that the person who represents you is a properly qualified.

Warning: Beware of unqualified "industrial advocates."

Recently, we have had several clients complain after being burnt, misled, ripped off and cheated by unqualified operators.  These "advocates" or "mediators" are not lawyers. They advertise heavily on the internet and in local newspapers. However, they are completely unregulated, do not have a law degree or legal training (one of them was a truck driver and a con artist); yet they charge fees similar to lawyers and more, without having any proper training or indemnity insurance.  They are not members of the Law Institute of Victoria, and they are not allowed to give any legal advice at all. 

Although they are sometimes allowed to operate as "agents" in some tribunals and the AIRC, they cannot represent you in court. In two recent cases, prospective clients who had been to a conciliation at the AIRC were unable to take their case to court because they had been misled by these crooks.  

NEED ADVICE OR URGENT ADVICE??

We offer a special urgent advice service1, including urgent telephone advice.  You may need to fax or email your documents to us - but we can generally respond very quickly. Fees apply as below.

Proper advice is invaluable at times of crisis - we deal with employment crisis situations daily. On numerous occasions we have saved our clients thousands of dollars. We have helped them cope with a very stressful time, and we have helped others save their jobs.

This service is very useful when:

  • You are asked to sign documents - for example, you may have been offered a redundancy payout.

  • You are asked to attend a meeting with management - maybe "investigation" or "discipline" is mentioned.

  • You need support making an important decision about your employment - especially if you're "stressed out" or under pressure.

  • You feel your employment is at risk for some reason.

  • Allegations have been made against you.

  • You are being pressured to resign. (Important note: If you are in this situation, do not resign unless you have first obtained proper legal advice.  Resigning can cost you some valuable legal rights, even if you feel you were forced to resign.

Bad decisions made in times of crisis can cost you your career, and can cost you many thousands of dollars, so it is worthwhile investing in proper advice.

Our "advice" fees are very competitive, currently: 

  • $275.00 flat fee for telephone consultation/advice with a lawyer2  

  • $330.00 flat fee for face-to-face office consultation/advice with a lawyer2

2(45 mins maximum lawyer's time including perusal of your documents. No extra charge for handling up to 15 pages of faxed or emailed documents.)
